1. Agreement to these terms

These Terms of Service govern your access to and use of the website located at beaivisible.ai and any related pages, forms, content, and resources we make available (the “Site”). The Site is operated by Ecco Consultants, doing business as Be AI Visible (“Be AI Visible,” “BAIV,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Who we are

Be AI Visible is an AI visibility and generative engine optimization consultancy. We help businesses improve how they are discovered, cited, and recommended by AI assistants and answer engines.

3. The Site versus our paid services

These Terms cover your use of the Site only. Any paid engagement, retainer, audit, or deliverable is governed by a separate written services agreement, proposal, or statement of work signed by both parties. If there is any conflict between these Terms and a signed services agreement, the signed services agreement controls for that engagement.

Nothing on the Site constitutes an offer to contract. Pricing, packages, and service descriptions shown on the Site are illustrative and may change at any time without notice.

4. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

5. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to the Site, our systems, or any connected network
  • Interfere with, disrupt, or place undue load on the Site or its infrastructure
  • Introduce viruses, malware, or any other harmful code
  • Scrape, crawl, harvest, or use automated means to extract data from the Site except for standard search engine and AI crawler indexing that we permit through our robots.txt file
  • Reproduce, resell, or commercially exploit any part of the Site without our prior written permission
  • Submit false, misleading, or fraudulent information through any form on the Site

6. Intellectual property

All content on the Site, including text, graphics, logos, icons, images, audio, video, data compilations, methodologies, frameworks, and software, is the property of Ecco Consultants or its licensors and is protected by United States and international intellectual property laws.

The Be AI Visible name, logo, and associated marks are our trademarks. You may not use them without our prior written consent.

You may view, download, and print content from the Site for your own internal, non commercial reference. All other rights are reserved.

7. Information you submit

When you submit information through a form on the Site, including a request for an audit, consultation, or contact, you grant us permission to use that information to respond to your request, evaluate a potential engagement, and communicate with you about our services. Our handling of personal information is described in our Privacy Policy.

Do not submit confidential or proprietary information through the Site. Information you send us through the Site is not treated as confidential unless it is covered by a signed non disclosure agreement between us.

8. No guarantee of results

AI visibility outcomes depend on factors outside our control, including the ranking, retrieval, and citation behavior of third party AI platforms such as ChatGPT, Claude, Perplexity, Gemini, and Google AI Mode. These platforms change their models, indexes, and citation logic frequently and without notice.

Any statistics, benchmarks, targets, timelines, case studies, or client results shown on the Site describe past or expected performance in specific circumstances. They are not a promise, warranty, or guarantee of any particular outcome for your business. Results vary.

9. Third party platforms and links

The Site may link to or integrate with third party websites, platforms, and tools that we do not control, including AI assistants, analytics providers, form and CRM systems, and scheduling tools. We provide these links and integrations for convenience only. We do not endorse and are not responsible for the content, policies, availability, or practices of any third party.

10. Disclaimers

The Site and all content on it are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non infringement.

We do not warrant that the Site will be uninterrupted, secure, error free, or free of viruses or other harmful components, or that any content on the Site is accurate, complete, or current.

Nothing on the Site constitutes legal, financial, tax, or professional advice.

11. Limitation of liability

To the fullest extent permitted by law, Ecco Consultants, its owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Site, whether based in contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or related to the Site will not exceed one hundred United States dollars (USD $100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ecco Consultants and its owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Changes to the Site and these Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after changes are posted means you accept the revised Terms.

15. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

16. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Salt Lake County, and you consent to the personal jurisdiction of those courts.

17. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with any signed services agreement, are the entire agreement between you and us regarding the Site. You may not assign these Terms without our written consent.
